Terms and Conditions

Walk With Him LLC (WWH) is a Texas limited liability company doing business as Krio Collections. These Terms of Conditions govern all sales through Krio Collections. 

DEFINITIONS. 

"Order(s)" means Customer's purchase and payment for materials and other items sold through Krio Collections. 

"Products" means the specific items identified on the Order.

"Customer" means the person placing the Order.

"Party" or "Parties" means Customer and WWH.

ORDERS; SHIPPING; DELIVERY. Upon authorization of payment method, Customer will receive a confirmation email. Orders are processed within 1-3 business days. Once the Order is processed, Customer will receive the Order within 3-5 business days for US orders or within the estimated delivery window shown at checkout. All orders received after 5pm CST will be processed the next day. Weekend delivery is not available.

WARRANTIES; DISCLAIMER; LIMITATIONS ON CLAIMS. WWH MAKES NO WARRANTIES, EXPRESS OR IMPLIED, CONCERNING THE PRODUCTS COVERED BY THIS AGREEMENT OR ANY AGREEMENT WITH CUSTOMER INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, OF MERCHANTABILITY OR AGAINST INFRINGEMENT, CUSTOMER HEREBY WAIVES ANY CLAIM (INCLUDING ANY CLAIM BASED ON STRICT OR ABSOLUTE LIABILITY IN TORT) THAT IT MAY HAVE AGAINST WWH, FOR ANY LOSS OR DAMAGE INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF INDIRECT, SPECIAL, INCIDENTIAL OR CONSEQENTIAL DAMAGE OR EXPENSE CAUSED BY A PRODUCT.

ENTIRE AGREEMENT; WAIVER. The Order shall constitute the entire agreement between the Parties and shall supersede all prior and contemporaneous proposals, negotiations and counterproposals. The Parties intend for the Order to be a final expression of the their agreement and a complete and exclusive statement of the terms and conditions thereof. A Party's failure to exercise or enforce any right in the Order, or any other right or privilege under law, or a Party's waiver of any breach by the other, shall not constitute a waiver or modification of any terms, conditions, privileges or rights whether of the same or similar type, unless the Party gives such waiver in writing. 

NOTICES. All notices pursuant to the Order shall be sent to customer-service@kriocollections.com. Notices sent in accordance with this provision shall be deemed to have been received at the time of transmission. 

CONSENT TO JURISDICTION. The Order shall be governed and interpreted in accordance with the laws of the State of Texas, without reference to principles of conflict of laws. The Parties exclude the application of the Convention on International Sale of Products to the Order. Any lawsuit or other judicial proceedings for the enforcement of this Agreement, or related to any provisions of this Agreement, shall be instituted only in courts with venue in Dallas County, Texas. Each Party hereby consents to personal and exclusive jurisdiction and venue in Dallas County, Texas.
